Actual Case History
Underwater Photo Shop - 1969
On one occasion the photographer agreed to work for the corporation, in the shop, for a period of one week while the working manager attended a camera repair course in another state. At this time the photographer was owed $378.00 for the last trip that he participated in as an instructor, plus the money he agreed to work for, during the week's training course. He was to be paid for the week upon the working managers return and the money owed for instruction would be paid two weeks later.
As soon as the working manager returned he paid the photographer for his weeks time in the shop, still owing the $378.00. Upon taking inventory at the shop the working manager found that one of the u/w photo meters was missing. He checked the rental sheets to see if the photographer had taken it out on rental (this was a convenience afforded any employee, at no charge, to get them familiar with equipment) and found no rental sheet.
Upon calling the photographer, the working manager found that the photographer had taken the meter home with him. The photographer said that he would return it when he got paid the $378.00. After discussing the situation with the corporation the working manager indicated to the photographer that he would have to return the u/w meter to the shop and that then, and only then, would he be paid.
The corporation refused the shipment and followed it with a letter indicating that the photographer had placed a $378.00 value on the meter and therefore he had been paid by the return of the meter. They also indicated that they would no longer need his services. CASE CLOSED!
